Misinformation” Law Declared Unconstitutional: 2 Things Every American Should Know.

It’s a big win for the 1st Amendment.

Judge Shubb of the U.S. District Court ruled that the state of California must halt its new COVID-19 “misinformation” and “disinformation” law, which aimed to crack down on spreading false information about the pandemic… and more.

The law championed by Gavin Newsome made it illegal to knowingly spread false information about COVID-19 vaccines, treatments, or government responses to the pandemic. Those found guilty of violating the law could face a $2,000 fine or up to a year in prison.

Five doctors sued California claiming the law violates their First Amendment rights to free speech and expression and their Fourteenth Amendment rights to due process of law.

Legal counsel for the doctors argued that the term “contemporary scientific consensus” is “undefined in the law and undefinable as a matter of logic.”

“No one can know, at any given time, the ‘consensuses’ of doctors and scientists on various matters related to the prevention and treatment of COVID-19,” the doctors said.

The judge agreed and deemed the law unconstitutional, stating that it violated the First Amendment’s protection of free speech. The judge also argued that while the spread of false information could be harmful, it was protected by the Constitution.

The judge was also concerned that the law would be used to silence criticism and opposition to government policies, leading to a chilling effect on free speech.

This is a good indicator of what the U.S. Supreme Court could rule for all of California.

1. This really shows how authoritarian and anti-free speech Newsom and his Socialist Supporters are

Newsom’s avid support for a law that would suppress free speech and virtually destroy the doctor-patient relationship tells us all we need to know. Newson has always supported Socialist big government, cradle-to-grave control of the people.

His tax and spending policies and job-killing regulations have bankrupted the state and made costs to live skyrocket, making more people poor.

His radical green policies have destroyed energy, gas, trucking, and the transportation business.

He’s also put unreasonable limits on the police, closed prisons, and let criminals out on the streets, increasing crime and decreasing the number of police on the streets- All for politically defined “equity.”

And the homeless problem is dangerous and out of control.

There isn’t an industry or social engineering program that Newsom hasn’t taxed or regulated, and Californians are suffering for it…

And he wants to become president.

2. Judicial activists vs. strict constructionists
This court ruling was based on the U.S. Constitution, not ideologically legislating from the bench.

Naturally, there are critics of Judge Shubb’s ruling—judicial activists who want activist judges who are like them and rule based on their personal “beliefs” on a matter or based on their own political ideology… We are the only ones in America to research, evaluate, rate, and tell you and others how to vote for judges nationwide.

Not on the Constitution or following the law as it’s written.

Judge Shubb followed the law and the constitution. He didn’t let his political opinions or personal feelings influence his decision.

Judge Shubb did exactly what a good and fair judge should do.
