The United States Supreme Court denied Maryville Baptist Church’s request for appeal to allow it to be awarded legal costs, after successfully challenging the Kentucky state’s COVID-19 pandemic lockdown rules. They refused to hear the case.
Like other churches that successfully fought an unconstitutional church shutdown, Maryville Baptist Church was entitled to attorney’s fees and other costs related to their successful litigation against Governor Beshear over COVID-19 restrictions.
A three-judge panel of the U.S. Court of Appeals for the Sixth Circuit unanimously ruled in favor of the church and its pastor, Jack Roberts.
Then another three-judge panel from the Sixth Circuit issued a unanimous opinion rejecting the church’s claims.
Without Supreme Court action, this ruling prevails – and the church loses.
