Key Takeaways:
- Many states allow illegal immigrants to obtain driver’s licenses.
- Because federal law requires states to allow voter registration when conducting DMV business, many illegal immigrants end up on voter registration rolls.
- Twenty-one states plus Washington, D.C. automatically register illegal immigrants to vote when they obtain a driver’s license.
- When these illegal immigrants then receive ballots in the mail, they assume they are qualified to vote.
- Federal law prohibits non-citizens from voting in federal elections.
- The SAVE America Act will end voting by illegal immigrants by requiring proof of citizenship to register to vote.
- The states are allowed to decide whether to conduct mass ballot distribution to voter registration lists, and to allow mass mail-in voting.
- Only Congress can end mail-in voting nationwide.
All states that require voter registration are required to allow residents to register to vote when they conduct business at their DMV.
This has been a federal law since 1993.
Currently, 21 states plus Washington, D.C. implement automatic voter registration when a person obtains or renews a driver’s license or ID – unless the person opts out.
Nineteen of these 21 states, plus Washington, D.C., allow illegal immigrants to obtain driver’s licenses.
Think about what this means regarding the potential for illegal immigrants to vote in federal elections – such as the upcoming 2026 midterm elections.
The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 – 18 U.S.C. § 611 – prohibits illegal immigrants from voting in federal elections.
Nevertheless, illegal immigrants could decide which political party controls Congress for the last two years of President Trump’s term.
What can be done – if anything – to prevent illegal immigrants and other non-citizens from voting in federal elections?
Here are 4 keys to obtaining legislative victory:
- Understand and answer the voter fraud propaganda campaign.
Democrats claim that voter fraud is a baseless conspiracy theory.
And the mainstream media bombards us with the Democrat narrative.
After the 2020 presidential election, The New York Times reported that they called election officials in every state and found no evidence of voter fraud that affected the outcome.[1]
Case closed, right?
Wait a minute… they interviewed the ones who were responsible for certifying the final vote count as being accurate and legal.
Of course the election officials going to say there was no voter fraud!
To admit knowledge of – or even suspicion of – any type of election fraud would have landed them in hot water.
The New York Times should have interviewed poll workers who actually handled the ballots, ran them through the vote tabulation machines – and followed the orders of supervisors.
Last December – more than 5 years after the 2020 election – voting irregularities surfaced in Georgia.
An attorney representing the Fulton County Elections Board admitted to missing and unsigned voting tabulation tapes – the printouts indicating how many votes a tabulation machine counted.[2]
This is why the FBI recently obtained a search warrant and seized ballots and voting records from the Fulton County election headquarters.
- Pass the SAVE America Act.
Originally this legislation was called the SAVE Act – Safeguard American Voter Eligibility Act.
The bill requires proof of U.S. citizenship when registering to vote in federal elections, which means producing either:
- A passport
- A U.S. birth certificate
- A REAL ID
The SAVE Act passed the House on April10, 2025.
It is currently stalled in the Senate.
The SAVE America Act – an update to the SAVE Act – was introduced in Congress in January 2026:
- By Rep. Chip Roy (R-TX) in the House
- By Sen. Mike Lee (R-UT) in the Senate
The SAVE America Act adds a requirement for photo ID when voting in federal elections.
This bill has not yet been scheduled for a vote.
Senate Majority Leader John Thune (R-SD) has indicated that it will come to the floor “at some point” – but as of yet, no timeline has been set.
- Eliminate mail-in voting.
Mail-in voting allows and invites the most voter fraud.
These 8 states and Washington, D.C. allow all elections to be conducted entirely by mail:
- California
- Colorado
- Hawaii
- Nevada
- Oregon
- Utah
- Vermont
- Washington
Nebraska and North Dakota leave the decision to conduct mail-in voting up to the individual counties.
In mail-in voting – which is different than absentee voting – ballots are automatically mailed to every person on a state’s or county’s voter registration list.
In every state that allows voter registration via the DMV, there will be illegal immigrants and other non-citizens who receive ballots in the mail.
Anyone who receives a ballot in the mail is going to assume they are eligible to vote.
This is why mail-in voting must be banned in all 50 states.
Any eligible voter who cannot vote in person can request an absentee ballot.
President Trump wants to end mail-in voting nationwide via an executive order.[3]
But if he issues such an order, it will undoubtedly be challenged in court and overturned as unconstitutional.
Article I, Section 4 of the Constitution gives state legislatures primary power to set the times, places and procedures for federal elections.
But Congress can pass laws to regulate or change rules set by the states.
Congress must act to end mass ballot distribution and mass mail-in voting.
- Understand and answer the voter ID propaganda campaign.
Democrats and the media claim that requiring a photo ID to vote at the polls is discriminatory.
Democrats and the media claim that requiring a photo ID to vote at the polls will “disenfranchise” eligible voters.
It’s long past the time for conservatives, independents, and Christians to respond by saying these are baseless conspiracy theories.
Thirty-six states already have laws requesting or requiring some form of ID to vote at the polls.[4]
A photo ID is required to:
- Drive a car
- Open a bank account
- Visit a hospital ER
- Apply for food stamps
- Get a free cell phone
- Cash a check
- …and so much more.
Requiring a photo ID to vote is no more discriminatory than requiring a photo ID for anything else.

FAQs:
- What federal law requires states to allow voter registration at the DMV?
A. The National Voter Registration Act of 1993 (NVRA) – often called the “Motor Voter” law – requires that all states except North Dakota (which has no voter registration requirement) offer voter registration opportunities at DMVs when people apply for or renew a driver’s license, change their address, or conduct certain other transactions. - Why is the “Motor Voter” law a bad idea?
A. Because 19 states plus Washington, D.C. allow illegal immigrants to get driver’s licenses. This means that in all of these states, illegal immigrants are considered registered voters even though they are not legally eligible to vote. - Why shouldn’t illegal immigrants be allowed to participate in U.S. elections?
A. Two reasons: (1) It is a violation of The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 – which prohibits non-citizens from voting in federal elections; (2) They have broken federal immigration law to enter the country illegally, and they have not demonstrated loyalty to the United States of America by taking the oath of citizenship and becoming a U.S. citizen.
